Terms of Service

1. Who we are
cofood.ing and cofooding.de are operated by Gastroexpress GmbH, Rosenheimer Str. 30-32, 81669 München, Germany (see the Impressum). By using the service you agree to these terms.
2. What Cofooding does
Cofooding lets a group of people order food together at a spot — an office, a floor, a building. Someone opens a round, everyone picks their dishes before the deadline, and the order goes to the restaurant as one delivery. The food is prepared and delivered by that restaurant with its own fleet. Cofooding is not a courier service and does not itself deliver food.
3. Your account and your spot
You sign in with your e-mail — a one-time code, or “Continue with Google” / “Continue with Microsoft”. Any address works: spots exist at workplaces and at home. Joining a spot makes your display name and your participation in its rounds visible to the other people in that spot. You are responsible for keeping access to your account secure and for orders placed under it.
4. Rounds and deadlines
A round has an order deadline. Until it passes you can change or remove what you ordered; after it passes the round no longer accepts orders, and what was ordered goes to the restaurant to be cooked.
5. Prices, fees and what you pay
Prices are shown in euro and include VAT, and the full amount is on the screen before you confirm. You pay for the dishes you chose plus your share of the delivery — there is no booking fee and no service fee. The delivery fee, and the order value from which delivery is free, are set by the restaurant for the area it delivers to; both are shown on the restaurant before you order, and both are fixed for the round at the moment it opens, so they cannot change under you while the round is running. A restaurant may also set a minimum order value, which is shown the same way.
6. Payment: reserved first, taken later
Where an order is paid on the platform you enter your card and the amount is reserved — held on your card, not debited. The money is taken only once the order is fixed: for a round, when the deadline passes and the order goes to the restaurant; for a catering order, when the restaurant confirms it. If the order never goes through, the reservation is released and nothing is taken. Card details are entered on our payment provider’s form and never reach our servers.
Some spots still settle for their food between themselves. Where that is the case the order screen says so before you confirm and no card is asked for.
7. Cancellation and refunds
Until the round’s deadline you can remove your dishes and nothing is charged — the reservation is simply released. After the deadline the food is being prepared, so the order can no longer be cancelled; this is the same rule as ordering directly from a restaurant. If what arrives is wrong, missing or never arrives, tell us on the same day and we settle it with you: a refund goes back to the card that was charged, we decide the case within two working days, and your bank typically shows the money within 5–10 working days. Full detail, and how to reach us, on the Support page.
8. No right of withdrawal for food
For consumers there is no right of withdrawal for the delivery of food and drinks, because these are goods that spoil quickly (§ 312g(2) no. 2 of the German Civil Code). This does not affect your ability to remove dishes free of charge until the order deadline, nor your statutory rights if what is delivered is defective.
9. Delivery and restaurant responsibility
Preparation, food quality and delivery are carried out by the restaurant with its own fleet. We pass the round’s order and the spot’s delivery details to that restaurant so it can serve you.
10. Acceptable use
Don’t misuse the service — no fraudulent orders, automated abuse, or interference with the platform. Spot links are meant for the people a spot is for; we may decline or cancel orders and suspend accounts that breach these terms.
11. Liability and governing law
To the extent permitted by law, Cofooding is not liable for indirect or consequential loss; nothing here limits liability that cannot be excluded by law. These terms are governed by German law, with jurisdiction in München where permitted.
